Privacy Policy

This Privacy Policy describes how your personal and non-personal information is collected, protected, used, and disclosed in connection with this application (the “App”) and the related web module (collectively, the “Service”). IHC Health Services, Inc. (“Intermountain Healthcare” or “we” or “our” or “us”) provides the Service to you through our independent contractor, mscripts, LLC (“mscripts”). For more information concerning our relationship with mscripts, please read Section 1 of the accompanying Terms of Service.

Information Collection
1. Personal Information.
  The Service offers registered-user access to send and receive your personally identifiable information to us and to mscripts. When you register for the Service, mscripts collects certain personal information that you submit to mscripts for your registration, including your name, date of birth, mobile phone number, email address, and a prescription number. When you use the Service, you may submit additional information to mscripts about the prescriptions and refills you are ordering. We also provide mscripts with personal information about you for the purpose of providing the Service to you, including your prescription and insurance information, demographic information and historical data about your prescriptions. For example, we provide mscripts with information about your prescriptions so that the Service can send you a refill reminder.
  
  When you or we submit your personally identifiable information to the Service, mscripts receives that information on our behalf as our independent contractor. Some of the personal information that you or we submit to mscripts, such as information about your prescriptions, may be Protected Health Information (“PHI”) protected by the Health Information Portability and Accountability Act (“HIPAA”). Mscripts receives that PHI as Intermountain Healthcare’s business associate.
2. Technical Information.
  mscripts may also collect certain technical data related to your use of the Service, including your IP address, the App pages and web pages you select as you navigate through the Service, your location and language, the operating system and browser for your device, and the identity of your network providers. mscripts uses third party service providers, such as Google Analytics, to analyze the operation of the Service. The manner in which Google collects and uses data in providing its analytics is described here: http://www.google.com/policies/privacy/partners/. mscripts may also use cookies to recognize Users. You may be able to configure your browser or device to reject cookies, but if you do so it may affect your ability to use the Service.
Information Use, Protection, and Disclose
1. Personal Information
  Intermountain Healthcare. We use, protect, and disclose your personally identifiable information and PHI that you submit to us or to mscripts using the Service in compliance with state and federal privacy and security rules (e.g., HIPAA) and Intermountain Healthcare’s Privacy Notices, which can be found at http://intermountainhealthcare.org/info/privacy-notices/Pages/home.aspx.
  
  mscripts. As our business associate and independent contractor, mscripts uses, protects, and discloses your personally identifiable information and PHI consistent with applicable state and federal health care privacy and security rules (e.g., HIPAA) and Intermountain Healthcare’s Privacy Notices to provide the service to you and to communicate with you about the Service.
  
  mscripts is authorized to de-identify personally identifiable information (including PHI) submitted by you or us through the Service in accordance with HIPAA and to aggregate that de-identified information with similar de-identified information from other mscripts’ users (collectively, “Aggregated Data”). Aggregated Data does not identify any individual User or User personal information. An example of Aggregated Data would be a finding that says, “81% of mscripts Users with a refill prescription for [Drug X] refilled the prescription”. mscripts uses the Aggregated Data for purposes of developing, improving, and marketing mscripts’ products and services.
  
  In order to operate its business, mscripts may disclose personal information to mscripts’ service providers and affiliated companies to the extent reasonably necessary to provide the Service to you. Any service providers or affiliates who receive personal information have agreed in writing to keep the information confidential and use it only to provide services to mscripts. mscripts may also be required to disclose personal information by court order or other law. In addition, if the business of mscripts is acquired by a third party, such as in a merger, asset sale or other corporate transaction, your personal information will be transferred to the buyer. The buyer will be required to comply with this Privacy Policy.

2. Technical Information.
  mscripts uses the technical data and cookies that it collects to operate, analyze and improve the Service.
Do Not Track Disclosure
The Service does not track Users’ behavior across third party applications or web pages that Users access before or after using the Service, and so does not respond to a “Do Not Track” signal.No third parties may track your behavior when using the Service.
Updating Your Personal Information
You may update and correct your telephone number or email address used in connection with the Service at any time through the App or by contacting mscripts at (866) 968-9523 or intermountain@mscripts.com.
Unsubscribing from the Service
You may unsubscribe from receipt of text messages at any time by texting STOP in reply to any text message from us or mscripts.

You may unsubscribe from receipt of email messages at any time by replying STOP in replay to any email message from us or mscripts.

You may unsubscribe from push-type messages and emails through the preference page of the App.

You may deregister from the Service at any time by contacting the mscripts support desk by email or telephone.
Modifications to this Privacy Policy
We may modify this Privacy Policy from time to time.If we make any material changes to this Privacy Policy, we will send email notice with a link to the modified Privacy Policy.That email notice may be delivered by mscripts.If you do not agree with the revised Privacy Policy, you may unsubscribe from the Service.If you continue to use the Service after the effective date of the change, you will be deemed to have agreed to the modified Privacy Policy.
Effect of Privacy Policy
This Privacy Policy forms part of, and is hereby incorporated into, the accompanying Terms of Service.
